harry reid decided he would just instead make a handshake deal with the republicans' top senator, mitch mcconnell. he said he was satisfied with the republicans just agreeing to be more reasonable on issues like this. remember? they wouldn't change the filibuster rules. they would just agree as gentlemen that the republicans would curtail the excesses of filibustering everything and effectively ruling from the minority. democrats decided to not change the rules on the filibuster and just make that agreement with the republicans instead. they said, you know, at a minimum this will at least improve the confirmation process for the administration's nominees. how is that working out now? just a couple of weeks later. how's that gentleman's agreement going? now that we've just had a filibuster of a cabinet nominee for the first time in american history. joining us now is andrea mitchell, nbc's chief foreign affairs correspondent, the host of "andrea mitchell reports" on msnbc. andr andrea, it's great having you here tonight. >> thank you very much. thanks, rachel. >> what happens next here?

i think harry reid is a difficult position. he wants obviously something to move forward that helps address part of the problem and i think if you look at 2014 and you look at the midterm elections, look at key states where democrats have to defend, red states, alaska, west virginia is an open seat, arkansas, these are rural states where the democrats have a different perspective on gun rights and have a better relationship, if you will, with the nra. that being said, i think everyone has come to terms that something needs to be done and the question is what can be done, what should be done, then also, what can pass not just the senate, by the way, but also the house. that's why i think you are seeing this movement towards not universal background checks. i personally don't like that term because i think it exaggerates what the reality is. we're talking about criminal background checks, strengthening what is already in place so that it's fair and balanced for everyone. >> one thing, though, with the senate and dianne feinstein

i think people will -- >> will harry reid bring it up for a vote? >> i hope so. >> what are you hearing? >> we think that people ought to be given the opportunity to offer bills, offer amendments on the senate floor. he said it's going to be an open process. >> so if schumer wants a bill, it'll get a vote. and you think that'll happen? >> i think so. >> let's talk about this trafficking bill. how much of a mark would that play? how much would that stop dangerous behavior with guns? if you were stopping people from buying guns who had a criminal intent? >> right now the penalty for that is something like the same as for trafficking livestock or chickens. and that's not a particularly stiff penalty and a lot of prosecutors don't want to do it. adding a penalty will make a difference. it's an important bill. >> if the call comes from chicago, i want to get semiautomatic weapons i'm going after a bank job, they would not suffer a serious criminal threat? >> straw purchasing for example is when somebody who is able to buy a gun because they have a clean
